Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

LEGISLATION CHANGES

Biosecurity (Human Biosecurity Emergency) (Human Coronavirus with Pandemic Potential) (COVID‑19 Rapid Antigen Tests) Determination 2022

  • Prohibits the practice of price gouging and the exportation of a COVID-19 rapid antigen test kit (RATs), unless an exception to the export restrictions under the Determination applies.

Defence Determination, Conditions of Service Amendment (COVID-19 Response - Domestic) Determination 2021 (No. 23)

  • Amends the Defence Determination 2016/19, Conditions of Service to update and provide additional benefits to Australian Defence Force (ADF) members and their families as a consequence of the changing COVID-19 pandemic in Australia and the effects it has on the movement of ADF personnel around Australia.

Defence Determination, Conditions of Service Amendment Determination 2021 (No. 24)

  • Makes various amendments to Defence Determination 2016/19, Conditions of Service including amendments to recreation leave during a journey during the COVID-19 pandemic.

Public Health (Diagnosed People and Household Contacts) Emergency Direction 2022 (No 2)

  • Requires people who are diagnosed with COVID-19 to self-isolate, and people identified as a household contact to undergo quarantine in order to limit the spread of COVID-19.

Public Health (Restricted Activities) Emergency Direction 2022 (No 1)

  • Imposes restrictions on certain businesses, activities and undertakings in relation to occupancy and density limits at premises, and the requirement to operate in accordance with COVID-19 safety plans where applicable to minimise the public health risk posed by COVID-19 in the Australian Capital Territory.

Public Health (Returned Travellers) Emergency Direction 2022 (No 1)

  • Requires persons travelling from overseas to either quarantine or undergo a COVID-19 test, depending on whether or not the person has been fully vaccinated, in order to limit the spread of COVID-19.

Critical Worker Exemption from the Public Health (COVID-19 Self-Isolation) Order (No 4) 2021 (No 1)

  • Exempts a critical worker from Clauses 7A and 8 of the Public Health (COVID-19 Self-Isolation) Order (No 4) 2021 for the purpose of attending work, subject to certain conditions - came into force on 9 January 2022.

Exemption Under Public Health (COVID-19 Self-Isolation) Order (No 4) 2021

  • Grants certain persons an exemption from Clauses 7A and 8 of the Public Health (COVID-19 Self-Isolation) Order (No 4) 2021 in certain circumstances and in relation to attending work for the employer - came into force on 7 January 2022.

Exemption Under Public Health (COVID-19 Self-Isolation) Order (No 4) 2021

  • Provides that certain exempt persons can leave their place of residence or other suitable accommodation to attend childcare, including travelling to and from the residence or facility, subject to certain conditions - came into force on 5 January 2022.

Public Health (COVID-19 General) Order (No 2) Amendment (No 5) Order 2022

  • Amends the Public Health (COVID-19 General) Order (No 2) 2021 to provide that an occupier of a hospitality venue, entertainment facility nightclub or recreation facility (major) must not allow a person to sing or dance on the premises, subject to certain conditions, and to remove a redundant provision - came into force on 8 January 2022.

Public Health (COVID-19 General) Order (No 2) Amendment (No 6) Order 2022

  • Prohibits singing and dancing by persons attending music festivals.

Public Health (COVID-19 Self-Isolation) Order (No 4) Amendment (No 3) Order 2022

  • Amends the Public Health (COVID-19 Self-Isolation) Order (No 4) 2021 to clarify that certain persons engaged by the Department of Education are also authorised contact tracers - came into force on 5 January 2022.

COVID-19 Directions (No. 2) 2022: Directions to Lock Out Whole of Territory

  • Restricts movement, gatherings and access to places, activities and services within the Northern Territory.

COVID-19 Directions (No. 3) 2022: Directions for Exclusion Zones

  • Restricts travel and entry into an exclusion zone except in certain circumstances.

COVID-19 Directions (No. 4) 2022: Directions for Infected Persons and Close Contacts

  • Imposes isolation and testing requirements for infected persons, and quarantine requirements for close contacts.

COVID-19 Directions (No. 5) 2022: Amendment to Directions (No. 2) 2022

  • Amends COVID-19 Directions (No. 2) 2022.

COVID-19 Directions (No. 6) 2022: Amendment of COVID-19 Directions (No. 3) 2022

  • Amends COVID-19 Directions (No. 3) 2022.

COVID-19 Directions (No. 7) 2022: Amendment of COVID-19 Directions (No. 3) 2022

  • Amends COVID-19 Directions (No. 3) 2022.

COVID-19 Directions (No. 8) 2022: Directions Requiring Evidence of Vaccination or Exemption for Places, Businesses, Activities, Services and Premises

  • Restricts entry to certain places, businesses, premises, activities and services by persons who cannot provide evidence of vaccination or exemption.

COVID-19 Directions (No. 9) 2022: Amendment of COVID-19 Directions (No. 08) 2022

  • Amends COVID-19 Directions (No. 8) 2022.

COVID-19 Directions (No. 10) 2022: Directions to Lock Out Yuendumu and Yuelamu

  • Restricts movement, and access to places, activities and services, in the lockout area and imposes requirements for face masks, testing and social distancing.

Determination of Exclusion Zones

  • Determines certain areas as exclusion zones for the purposes of Direction 3 of the COVID-19 Directions (No. 131) 2021: directions for Territory Border Restrictions.

Border Restrictions Direction (No. 60)

  • Specifies requirements for entry to Queensland.

COVID-19 Hotspots and Border Zone Declaration

  • Identifies COVID-19 hotspots and restricted and non-restricted Border Zone LGAs for certain public health directions, and moves the remaining areas of the Moree Plains Shire LGA to the non-restricted Border Zone.

Isolation for Diagnosed Cases of COVID-19 and Management of Close Contacts Direction (No. 3)

  • Specifies the requirements that apply to individuals who have received a positive COVID-19 diagnosis and who are close contacts, either as household members of a diagnosed case or who have had household-like contact for more than four hours in a house, other accommodation, and similar settings.

Approval by the Governor of Extension of a Major Emergency Declaration

  • Extends the Major Emergency declared on 22 March 2020 for 28 days commencing on 8 January 2022.

Emergency Management (Appropriate Surgery During COVID-19 Pandemic No 6) Direction 2022

  • Ensures that healthcare resources are available to respond to the immediate needs of persons infected with COVID-19.

Emergency Management (Healthcare Setting Workers Vaccination No 5) (COVID-19) Direction 2022

  • Maintains the provision of healthcare services operating in the State despite the presence of COVID-19 in the community, minimises the disruption to those services due to the spread of COVID-19 amongst healthcare setting workers or workers being furloughed following possible exposure, and reduces the risk of the spread of COVID-19 by healthcare setting workers to patients.

Emergency Management (In-home and Community Aged Care and Disability Support Workers Vaccination No 3) (COVID-19) Direction 2022

  • Reduces the risk of COVID-19 transmission to vulnerable members of the community by persons providing them in-home or community-based care, maintains the provision of in-home and community-based aged care and disability support services despite the presence of COVID-19 in the community, and minimises the disruption to those services due to the spread of COVID-19 amongst workers or workers being furloughed following possible exposure.

Emergency Management (Residential Aged Care Facilities No 45) (COVID-19) Direction 2022

  • Ensures that appropriate measures are taken to establish controls and safeguards to protect vulnerable members of the South Australian community, including by imposing restrictions on visitors and mandating vaccination and record-keeping requirements.

Direction Under Section 16 (Isolation - No. 6)

  • Requires persons diagnosed with COVID-19 to isolate.

Extension of Pandemic Declaration

  • Extends the pandemic declaration made on 10 December 2021 for three months until 11:59 pm on 12 April 2022.

Pandemic (Additional Industry Obligations) Order 2022 (No. 2)

  • Imposes additional specific obligations on employers and workers in meat processing facilities, seafood processing facilities, supermarket work premises and perishable food work premises, warehousing and distribution centres, commercial cleaning services, care facilities, ports of entry servicing international arrivals, hotel quarantine, hospitals and construction sites in relation to managing the risk associated with COVID-19 - came into force at 11:59 pm on 6 January 2022.

Pandemic (Open Premises) Order 2021 (No. 2)

  • Imposes obligations upon operators of certain open premises in Victoria and their patrons in relation to vaccination against COVID-19 and other requirements - came into force at 11:59 pm on 6 January 2022.

Pandemic (Quarantine, Isolation and Testing) Order 2022 (No. 3)

  • Requires persons to limit the spread of COVID-19 including by requiring persons who are diagnosed with COVID-19 or probable cases to self-isolate, close contacts to self-quarantine and undertake testing, or exposed persons, social contacts or symptomatic persons in the community to observe relevant testing requirements issued by the Department (there are different requirements for self-quarantine and testing depending on the level of exposure to someone diagnosed with COVID-19) - came into force at 11:59 pm on 6 January 2022.

Pandemic (Workplace) Order 2022 (No. 2)

  • Restricts the number of Victorians attending work premises, imposes specific obligations on employers to assist in reducing the frequency of outbreaks of COVID-19 in Victorian workplaces, imposes additional work premises specific obligations on employers determined by the type of premises and specifies the appropriate response of an employer in the circumstance of a symptomatic person or confirmed case of COVID-19 in the work premises - came into force at 11:59 pm on 6 January 2022.

Controlled Border for Western Australia Amendment Directions (No 58)

  • Amends the Controlled Border for Western Australia Directions in relation to children requirements, among other things.

Controlled Border for Western Australia Amendment Directions (No 59)

  • Amends the Controlled Border for Western Australia Directions high and medium risk jurisdictions.

COVID Restrictions (Gatherings and Related Measures) Directions (No 5)

  • Restricts entry to certain premises by people who do not produce accepted proof information, requires the wearing of a face covering in the affected area and gives further directions in order to prevent, control or abate the risks associated with the emergency presented by the pandemic caused by COVID-19 following the detection of a positive case of COVID-19 in the Western Australian community and to otherwise limit the spread of COVID-19.

COVID-19 Testing Directions (No 4)

  • Prohibits a person from requesting or conducting testing for COVID-19 except in accordance with these directions, as unauthorised testing wastes resources required to prevent, control or abate the serious public health risk presented by COVID-19.

Outbreak Outside of Western Australia Response Directions (No 19)

  • Helps prevent the importation of COVID-19 into Western Australia following an outbreak or outbreaks of COVID-19 outside of Western Australia, and otherwise limits the spread of COVID-19 in Western Australia.

Presentation for Testing Directions (No 37)

  • Imposes testing requirements for certain persons.
